On 25 October 2017, FERC released its Final Report pursuant to President Trump’s Executive Order 13783 to determine whether existing regulations and agency actions potentially burden the development or use of domestically produced energy resources.
FERC reviewed its regulation requiring the mandatory pre-filing environmental review process for LNG terminal and related pipeline project certification and concluded that “although this regulation may result in delays or additional costs to the applicant early on in a project’s development, its overall result is a more timely application review by considering all issues regarding a project concurrently. As such, there is no need for the Commission to consider any revision to this regulation.”
